General Terms and Conditions for the Service of Auto Assistance (via Self-Management)

I. Preliminary Definitions

- ASSIST CARD: Shall be and it is understood is any member of the ASSIST CARD group.

- ASSIST CARD Client: The entitled physical person holding an ASSIST CARD voucher, who having downloaded the mobile application, requires any of the Travel Assistance Services that are available and susceptible of being “self-managed”.

- Service of Auto Assistance: The option offered by ASSIST CARD through its mobile application so the entitled ASSIST CARD Client that is in the determined locations and presents any of the predetermined symptoms, in said mobile application, may personally require the assistance of a doctor to their home or location of preference where they are physically present.   

- Predetermined Locations: This refers to the territory in which the ASSIST CARD client may exercise the option of the Auto Assistance/Self-Management Service feature. 

II. General Terms and Conditions for the Auto Assistance/Self-Management Service.

The present general terms and conditions (hereinafter referred to as “GTC/General Conditions”) regulate the terms and conditions of access and use of the Auto Assistance/Self-Management Service, which makes ASSIST CARD available to the extent and to the limits defined in these General Conditions, which the ASSIST CARD Client must read, understand and accept to make use of the service and obtain the advice that is provided by activating it.   

The accessing/activating and or use of Auto Assistance/Self-Management Service, of all or part of its contents, implies the full acceptance of these General Conditions.    

The Auto Assistance/Self-Management Service consist of the possibility that the ASSIST CARD Client requests, through the ASSIST CARD mobile application, a medical visit in person at the address in which he/she is located, in the event of presenting any of the health symptoms predetermined by ASSIST CARD in said mobile application.  The medical assistance that the ASSIST CARD Client may require through the Auto Assistance/Self-Management Service feature will be performed by qualified professionals that are members of the ASSIST CARD Provider Network.   

ASSIST CARD may modify these General Conditions at any time, after giving notice to ASSIST CARD Clients who would have made use of the option for Auto Assistance/Self-Management Service.

III. Particular Conditions of use for the Auto Assistance/Self-Management Service.

These are Particular Conditions of use for the Auto Assistance/Self-Management Service:

a)       The option of the Auto Assistance/Self-Management Service offered by ASSIST CARD does not replace or substitute the possibility of ASSIST CARD Customers to request medical assistance through the telephone via the authorized lines in effect for this purpose.   

b)      The Auto Assistance/Self-Management Service is available for ASSIST CARD Clients that are of legal age (18 years) and older.

c)       The Auto Assistance/Self-Management Service is available and enabled only for the ASSIST CARD Customers located in the City of Miami, Orlando (within the United States of America) and in Madrid, SPAIN.

d)      If necessary and at the discretion of the professional consulted for care, the ASSIST CARD Client may be referred to a specialist physician, or may be sent for diagnostic or treatment studies.

e)      [In case of emergency, the ASSIST CARD Customer must contact the ASSIST CARD Service Center by telephone.

f)        The Auto Assistance/Self-Management Service is available to ASSIST CARD Clients who have successfully fulfilled the registration in the ASSIST CARD mobile application and who have completed all of the information required by ASSIST CARD in order to enable the Auto Assistance/Self-Management option feature.   

g)       ASSIST CARD reserves the right to terminate, suspend and /or cancel the Auto Assistance/Self-Management Service without this generating an “acquired right” for the ASSIST CARD Client.   

h)      The Auto Assistance/Self-Management Service is not enabled in case of presenting any symptom different from those previously established by ASSIST CARD in its mobile application.

IV. ASSIST CARD Customer Obligations

The ASSIST CARD Client shall observe, respect and comply at all times with the terms and conditions established in these General Terms and Conditions for the Auto Assistance/Self-Management Service.  The ASSIST CARD Client expressly states that he/she will use the Service responsibly, diligently and assuming any responsibility that may arise from breach of these General Conditions.

The ASSIST CARD Client declares and agrees that he/she will only use the Auto Assistance/Self-Management Service to affect their own health and not to another or third party.   

The ASSIST CARD Client declares and agrees that ASSIST CARD will not be responsible for any worsening of the eventual clinical state, in case the ASSIST CARD Client has incurred, in any related omission.   

V. Intellectual and Industrial Property

All contents, trademarks, domains, logos, drawings, documentation, computer programs or any other element susceptible of protection by the intellectual or industrial property laws, that are accessible through the ASSIST CARD mobile application, or the ASSIST CARD website, correspond exclusively to ASSIST CARD.  It is expressly prohibited to create hypertext links (link) to any element of mobile application without the written consent and prior authorization of ASSIST CARD.

VI. Applicable legislation, jurisdiction and notifications

Any relationship that is generated by this Auto Assistance/Self-Management Service between ASSIST CARD Clients and the Provider shall be governed and agreed upon in full compliance with the laws of the Eastern Republic of Uruguay, with ASSIST CARD customers waiving any other law whose application may have a right.
